The petitioner seeks bail in connection with Katra P.S. Case No. 71 of 2012 registered for the offences punishable under Section 396 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that on the basis of the confessional statement of co-accused persons, the name of the petitioner transpired in this case and nothing has been recovered from the possession of the petitioner. It has further been submitted that the petitioner has criminal antecedent in another case in which the petitioner is on police bail and he is in custody since 02.09.2016. Heard the learned APP also.

Patna High Court Cr.Misc. No.48698 of 2016 (3) dt.20-12-2016 2/2 Having heard both sides, in view of the fact and the confessional statement of the co-accused persons and nothing has been recovered from the possession of the petitioner, let the petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Judicial Magistrate, 1st Class, Muzaffarpur in connection with Katra P.S. Case No. 71 of 2012.
