JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-12-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in a case registered for the offences punishable under Sections 399,402 of the Indian Penal Code and 25(1-b) a 26/35 of the Arms Act. Admittedly, neither petitioner was caught on the spot nor anything was recovered from his conscious possession and the name of petitioner was disclosed by co-accused, who were apprehended at the spot. Moreover, except the present case as well as Baniyapur P.S.Case No. 172 of 2018, there is no any other criminal antecedent of the petitioner.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition
Patna High Court Cr.Misc. No.73424 of 2018(2) dt.20-12-2018 2/2 is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate -IV Saran at Chapra in Baniyapur P.S. Case No. 187 of 2018 subject to condition as laid down under Section 438(2) of the Cr.P.C.
