The petitioner apprehends his arrest in Bhagwanpur P.S. Case No. 167 of 2018, registered for the offences punishable under Sections 304B, 34 of the Indian Penal Code. It is a case of dowry death. Petitioner happens to be husband of the deceased.
It is submitted that there is general and omnibus allegation against all the FIR named accused person of demand of dowry. In fact, the deceased committed suicide and petitioner never demanded dowry or committed torture.
Counsel for the State however, vehemently opposed the prayer for bail and submitted that petitioner is husband of the deceased and main allegation of demand of dowry is against this petitioner.
Considering the facts aforesaid and the nature of
Patna High Court CR. MISC. No.31031 of 2021(3) dt.30-06-2022 2/2 allegation and the fact that petitioner is husband of the deceased and deceased died in unnatural circumstance within seven years of her marriage at her matrimonial home, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
