Mr.Mohammad Sufyan ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-12-2022 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 307, 379 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

As per the FIR, all the FIR named accused persons

Patna High Court CR. MISC. No.23865 of 2022(4) dt.08-12-2022 2/2 including petitioners assaulted the informant with lathi and danda. The accused persons snatched cash of Rs. 40,000/- from possession of informant. When informant's wife came to rescue she was also assaulted by the accused persons. The accused persons snatched gold chain from her neck and also made two rounds of firing.

It is submitted that both parties are Gotias and there were quarrel among the children of both families, as a result of the alleged occurrence took place. There is case and counter case. Allegation of assault is general and omnibus. Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Biharsharif, Nalanda in connection with Sarmera P.S. Case No. 95 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
