1. The present petition has been filed for restoration of a petition bearing MJC No.681 of 2020, which has been dismissed on account of non compliance of the peremptory order dated 13.07.2022.
2. The learned counsel for the petitioner has submitted that since he had met with an accident, he was bed ridden for about six months, hence he could not remove the defects, within
Patna High Court MJC No.1049 of 2024(2) dt.10-04-2024 2/2 the time, granted by this Court, thus a sympathetic view be taken and the aforesaid contempt petition be restored to its original file. The learned counsel for the petitioner further assures this Court that the defects, pointed out by the Registry will be removed within a period of two weeks from today.
3. Having regard to the facts and circumstances of the case, considering the averments made in the present petition and taking into account the submissions made by the learned counsel for the petitioner, I deem it fit and proper to direct for restoration of the aforesaid petition, bearing MJC No.681 of 2020 to its original file, subject to the petitioner removing the defects, pointed out by the Registry, within a period of three weeks from today.
4. The present petition stands disposed off on the aforesaid terms.
