JUSTICE RAKESH KUMAR ORAL ORDER 08-08-2016 Heard Sri Chandra Moleshwar, learned counsel for the petitioners and Sri Arun Kumar Pandey, learned A.P.P. Two petitioners, have approached this court under section 482 of the Code of Criminal Procedure , with a prayer to quash an order dated 21.6.2013 passed by the learned Additional Sessions Judge -7, Danapur, Patna in Sessions Trial No. 594 of 2013 arising out of Dulhin Bazar P.S. Case No. 59 of 2011. By the said order petition filed on behalf of the petitioners under section 227 of the Cr.P.C. has been rejected. Learned counsel for the petitioners tried to persuade the court that there was already partition in between the husband of the deceased and petitioners and petitioners were residing separately. This fact has come during investigation even then the

Patna High Court Cr.Misc. No.27280 of 2013 (3) dt.08-08-2016 2/2 petitioners were forwarded as accused. On this very ground a prayer has been made for discharge of petitioners whereas after going through the impugned order the Court is satisfied that there is no error warranting interference.

The petition stands dismissed.
