The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 306/201/34 of the Indian Penal Code.

The petitioner is first wife of co-accused Surendra Pandit @ Suresh Pandit who allegedly kidnapped Neha Kumari, the daughter of the informant and married with her. Thereafter Neha Kumari gave birth to a baby. Later on dead body of Neha Kumari was found near a railway track.

Allegation is that she was done to death on nonfulfilment of the demand by the accused persons to withdraw the kidnapping case.

No.9444 of 2017 (2) dt.16-03-2017 2/2 Submission of the petitioner is that the petitioner is the first wife of Surendra Pandit @ Suresh Pandit and during investigation it reveals that the victim along with her minor child was dashed by the running train. Hence, the matter was of an accidental death and even if allegation is assumed to be correct there is no evidence of suicide as a result of abetment of this petitioner.

Considering the nature of allegation and the fact that petitioner is a female, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-XIII, Muzaffarpur/Successor Court in connection with Sadar Police Station Case No. 221 of 2012, giving rise to Sessions TrialNo.701 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
