Petitioner seeks bail in Nawada Town P.S. Case No. 229 of 2018 registered for the offence punishable under Sections 392 and 386 of the Indian Penal Code and subsequently sections 395 and 412 of the IPC were added.

Informant who is a Godown Incharge of gas agency has alleged that on 13.04.2018 at about 5:30 pm when he was making final settlement of accounts, two unknown criminals entered there and snatched away his mobile and Rs. 6500/- from his possession and also demanded ransom of Rs. 2 Lacs. It has been submitted on behalf of the petitioner that the name of the petitioner has surfaced in this case on the basis of confessional statement of co-accused Md. Sabir who has already been granted bail vide order dated 20.09.2018 in

Patna High Court Cr.Misc. No.70639 of 2018(2) dt.10-12-2018 2/3 Criminal Miscellaneous No. 49577 of 2018. Except the confessional statement there is no incriminating material against the petitioner. Similarly, situated co-accused person has been granted bail by a co-ordinate bench of this Court vide order dated 05.07.2018 in Criminal Miscellaneous No. 37979 of 2018. Petitioner has got no criminal antecedent and is in custody since 21.08.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada, in connection with Nawada Town P.S. Case No. 229 of 2018, with following conditions:- (1)Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner. (4). If the petitioner is found involved in similar nature of offence, after his release on bail, the trial court shall
