====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 03-12-2018 Heard Mr. Md. Qumrul Hoda, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner who is in custody since 02.09.2018 in connection with Sadar P.S. Case No. 488 of 2018 registered for the offence under Sections 147/148/149/332/333/336/353/307/427/290/435/323/341 of the Indian Penal Code, 1860 has prayed for grant of bail. At the very outset learned counsel for the petitioner has drawn my attention to the statement made in paragraph 3 of the petition to show that petitioner is having clean antecedent. He further submits that in the case about 200 persons were arrayed as accused. In a case in which due to accident two persons died, villagers assembled

Patna High Court Cr.Misc. No.70693 of 2018(2) dt.03-12-2018 2/2 and it was alleged by Police that Police Party was assaulted by the villagers. Learned counsel for the petitioner submits that petitioner only being villager has been made accused otherwise there is no material to show active participation of the petitioner in the occurrence.

Be that as it may, considering the nature of accusation, clean antecedent of the petitioner as well as period of custody, let the petitioner - Pawan Thakur be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( ten thousand ) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea / concerned court in connection with Sadar P.S. Case No. 488 of 2018.
