2. Petitioner is in custody since 03.09.2016 in connection with Sherghati P.S. Case No. 413 of 2016 for the offences punishable under Sections 272, 273 & 414 of the Indian Penal Code and Section 47/A of the Excise Act.

3. The accusation is of carrying illegal wine.

4. Learned counsel for the petitioner has submitted that the petitioner has been implicated in this case on mere suspicion. It is further submitted that the petitioner is the passenger of the vehicle on which wine was being carried and no recovery has been made from the conscious possession of the petitioner.

5. Considering the facts and circumstances of the

Patna High Court Cr.Misc. No.47708 of 2016 (4) dt.28-01-2017 case and nature of accusation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Sherghati, in connection with Sherghati P.S. Case No. 413 of 2016.
