Petitioners are apprehending their arrest in connection with Kudra PS Case No. 342/2018 for the alleged offence under Section 414 of the Indian Penal Code and Sections 11(1) (2) (d) (e) (f) of the Prevention of Cruelty to Animal Act, 1960. Learned counsel representing the petitioners submits that petitioners have no criminal antecedent. He further submits that petitioners have been falsely implicated in the case. There is absolutely no question of cruelty to the animal. Petitioners are the owner and driver of the vehicle and there was no animal in the vehicle.

Considering the aforesaid, this application for grant of anticipatory bail is allowed.

No.74397 of 2018(2) dt.21-12-2018 2/2 Accordingly, in the event of arrest or surrender before the court below within a period of one month from today, the petitioners above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate IV, Kaimur at Bhabhua in connection with Kudra PS Case No. 342/2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
