This is an application for grant of anticipatory bail on behalf of the petitioner in Dariyapur P.S. Case No. 181 of 2018, registered under Sections 147, 148, 149, 341, 323, 307, 354, 504 and 506 of the Indian Penal Code.
There are 26 persons named in the FIR, including the petitioner. Many of the accused persons have been granted anticipatory bail by this Court by order dated 20.09.2018, passed in Cr. Misc. No. 50257 of 2018.
Though, there is allegation against the petitioner of causing injury by inflicting knife blow on the face of the informant, learned counsel, appearing on behalf of the petitioner, has submitted that there is no injury report to support
Patna High Court Cr.Misc. No.73014 of 2018(2) dt.19-12-2018 2/2 the said allegation. The occurrence appears to have taken place as a sequel to a quarrel between the parties. Considering the above submission, this application is allowed. Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of the learned A.C.J.M.-IV, Saran at Chapra in Dariyapur P. S.Case No. 181 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
