The Petitioner apprehends his arrest in connection with Nanpur P.S. Case No.50 of 2020, registered for the offences punishable under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-b)A/26/35 of the Arms Act. It is alleged that the petitioner and other co-accused persons were planning for committing dacoity. It is alleged that the petitioner fled away from the place of occurrence after seeing the police.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is further submitted that the petitioner has got one criminal antecedent as stated in paragraph-3 of the bail

Patna High Court CR. MISC. No.22549 of 2022(2) dt.25-08-2022 2/2 application. The petitioner is made accused in the present case on the basis of confessional statement of the apprehended person, namely, Manish Kumar. It is further submitted that no incriminating article has been recovered from the conscious possession of the petitioner.

Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Taking into consideration the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sitamarhi in connection with Nanpur P.S. Case No.50 of 2020, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
