NATH ORAL ORDER 02-11-2015 Heard Mr. Ashok Kumar Sinha, the learned counsel for the petitioners and the learned counsel for the respondent no. 2. In view of the provision as contained in Order 21 Rule 103 C.P.C. providing for appeal against the order passed on a petition under Order 21 Rule 97 or 99 C.P.C., Mr. Sinha, the learned counsel for the petitioners has sought permission to withdraw this writ application with liberty to the petitioners to file appeal in accordance with law against the impugned order. The learned counsel for the respondent has raised no objection.
Patna High Court CWJC No.174 of 2014 (8) dt.02-11-2015 The prayer for withdrawal of this writ application is allowed with liberty to the petitioners to file appeal in accordance with law against the impugned order. The fact of pendency of this application before this Court may be considered in accordance with law while considering the prayer for condonation of delay in filing the appeal.
