JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 14-10-2015 Heard learned counsel for the petitioner, informant and the State.
The petitioner apprehends his arrest in a case under Sections 341, 323, 307, 504/34 of the Indian Penal Code. The petitioner submits that the injuries sustained by the informant is superficial in nature and in no case it will come under Sections 307 of the Indian Penal Code.
As per the allegation, the petitioner has pressed the stomach of the informant with his legs.
As the petitioner is alleged to have committed overt act and he is named in the F.I.R., I am not inclined to grant anticipatory bail to the petitioner. His prayer for grant of anticipatory bail is rejected. However, he would surrender before
Patna High Court Cr.Misc. No.43888 of 2015 (2) dt.14-10-2015 2 / 2 the court below (Judicial Magistrate, Saran, Chapra) and prays for bail.
