The petitioner seeks bail in S.T. NO.107 of 2018 arising out of Salkhua P.S. case No.40 of 2017 registered under Sections 147, 148, 149, 341, 342, 302 of the Indian Penal Code and 27 of the Arms Act, pending in the court of Sri H.D. Patel, Fast Track Court, Saharsa.
The earlier bail application of the petitioner was rejected vide Annexure 1 to the present application taking into account that the petitioner is the assailant. A report was called for from the court below regarding the stage of trial. It has been reported that the trial has already started and the trial is expected to be concluded within a period of 9 to 10 months.
Patna High Court CR. MISC. No.19654 of 2019(5) dt.09-08-2019 2/2 Considering the nature of accusation and the stage of the trial, I am not inclined to grant bail to the petitioner. The same is rejected.
The Trial Court is directed to take all necessary steps to conclude the trial preferably within a period of ten months from the date of receipt/production of a copy of this order. The District Magistrate, Saharsa and the Superintendent of Police, Saharsa are also directed to take necessary steps to produce the witnesses on the date fixed by the Trial Court so that the trial could be concluded within the stipulated period.
