The petitioner seeks bail in Sour Bazar P.S. Case No. 561 of 2017 instituted for the offence under Section 395 of the Indian Penal Code.
Counsel for the petitioner submits that petitioner is not named in the written report. There is no recovery of any incriminating article from possession of the petitioner. No Test Identification Parade has been held. Counsel for the petitioner further submits that Police on Mobile surveillance arrested Md. Mohid who disclosed the name of petitioner in his confessional statement.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the
Patna High Court Cr.Misc. No.69940 of 2018(2) dt.03-12-2018 2/2 petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, in connection with Sour Bazar P.S.
