Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 363 and 366(A) of the Indian Penal Code, registered in connection with Piri Bazar P.S.Case No. 71 of 2020.

The learned counsel for the petitioner has submitted that the victim has solemnized her marriage with the petitioner. The age of the victim, as per the medical report, which is annexed with the record is 19 to 20 years. He has

Patna High Court CR. MISC. No.23074 of 2022(2) dt.11-10-2022 2/2 submitted further that there is a child out of the wedlock of the couple. The mother of the victim has filed her affidavit mentioning the petitioner as her son-in-law.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Kakhisarai in connection with Piri Bazar P.S.Case No. 71 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
