====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-07-2023 Heard learned counsels for the petitioners and the State.

Petitioners apprehend arrest in a case registered for the offences punishable under Sections 341, 323, 354, 379, 308, 504, 506/34 of the Indian Penal Code.

On account of an old land dispute over which litigation was going on between the parties, it is alleged that these petitioners along with family members were constructing house and when the informant and her daughters went to oppose, then all the accused persons abused and assaulted them by means of lathi, stick, farsa and iron rod. Learned counsel appearing for the petitioners submits

Patna High Court CR. MISC. No.22011 of 2023(2) dt.07-07-2023 2/2 that there is case and counter case between the parties. Doctor has found the injuries to be simple in nature. Petitioners have got clean antecedent.

Considering the aforesaid facts and circumstances, this anticipatory bail is allowed and it is ordered that the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, East Champaran, Motihari in connection with Mehsi P. S. Case No. 302 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
