The petitioner seeks regular bail in connection with Laukaha P.S. Case No. 214 of 2018 for the offenses punishable under Sections 272, 273 and 290 of the Indian Penal Code and Sections 30(a) and 37(b) of the Bihar Wine Prohibition and Excise Act, 2016.

The allegation against the petitioner is that the petitioner and other co-accused persons were carrying load over their head and when they were apprehended by the Police, other co-accused persons managed to escape. However, the petitioner was apprehended and from the load being carried by the said persons 69 litres of illicit liquor was recovered The learned counsel for the petitioner submits that the

Patna High Court Cr.Misc. No.69848 of 2018(2) dt.11-12-2018 2/2 petitioner is innocent and has a fair antecedent. He is accused in one another case in which he is on bail. The petitioner is stated to be languishing in custody since 24.08.2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District & Sessions Judgecum-Special Judge, Excise Act, Madhubani in connection with Laukaha P.S. Case No. 214 of 2018.
