JUSTICE RAKESH KUMAR ORAL ORDER 06-07-2015 Heard learned counsel for the petitioner, learned AC to AAG No. 10 and Mr. Najmul Hoda, learned counsel who has appeared on behalf of the private respondent. The present writ petition is in relation to a dispute under Section 48D of the Bihar Tenancy Act, 1885 which is a scheduled Act under the provisions of Bihar Land Tribunal Act, 2009. Since the Bihar Land Tribunal constituted under the Bihar Land Tribunal Act, 2009, is already functioning, the court considers that this matter can well be adjudicated by the Bihar Land Tribunal.

Accordingly, in terms of proviso to Section 15 of the Bihar Land Tribunal Act 2009, the Registry is directed to transmit the record of this case to the Bihar Land Tribunal forthwith. (Rakesh Kumar, J) Praful/- U
