JUSTICE SHIVAJI PANDEY ORAL ORDER 18-12-2020 Heard Mr. Manoj Kumar Pandey, learned counsel for the petitioner and Mr. Binod Kumar No.3, representing the State. In this case, the petitioner is apprehending his arrest in connection with Bakhtiyarpur P.S. Case No. 64 of 2018 registered for offences under sections 419, 420, 467, 468, 399, 402, 120(b) of the Indian Penal Code and Section 25(1-b) 26/35 of the Arms Act.

The present First Information Report has been lodged at the instance of police personnel on the basis of his Fardebyan wherein interalia it has been stated that on 8.2.2018 at about 11 pm, he along with co-police officials proceeded for raid but, on the way, he received information that the criminal Rocky Kumar is present along with his 8-10 associates in Rawaich play ground where they were making a conspiracy for committing dacoity. The raiding party proceeded there and surrounded them

Patna High Court CR. MISC. No.22011 of 2020(3) dt.18-12-2020 2/2 but, all the accused persons fled away from there except one Rocky Kumar who was arrested along with the country made pistol. He stated his name and also his associates and one of them is the present petitioner.

Learned counsel for the petitioner submits that there is no specific allegation of any over act against the petitioner and his name has surfaced on the confessional statement of the accused Rocky Kumar.

The Court has perused the Case Diary and finds that after investigation, the police has submitted the charge-sheet against the petitioner.

In view of the above, this Court is not inclined to grant anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail of the petitioner, above named, is rejected.

If the petitioner surrenders before the court below within a period of four weeks from today and makes a prayer for bail, the court below, without being prejudiced by this order, will pass orders in accordance with law.
