In this case, the petitioner is seeking regular bail in connection with K. Hat (Sahayak) P.S. Case No. 807 of 2019 registered for offence punishable under section 414 of the Indian Penal Code and sections 25 (1-b) and 26/35 of the Arms Act. The police arrested the petitioner with the motor cycle along with loaded pistol.

The counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 23.11.2019.

Looking to the entirety of the fact, let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- with

Patna High Court CR. MISC. No.21816 of 2020(4) dt.13-11-2020 2/2 two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in connection with K. Hat (Sahayak) P.S. Case No. 807 of 2019, subject to the condition that one of the bailors of the petitioner shall be a close relative. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. If the petitioner is found to be involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of his bail bond and the court below will pass an appropriate order.
