Learned counsel for the petitioner submits that the parties have entered into a compromise and the opposite party no.2 has filed an application in the Court below for withdrawal of the case.

In that view of the matter, this application is disposed of with a direction to the Special Judge to consider the application of withdrawal within 15 days of communication of this order. If the opposite party no.2 supports the withdrawal application, the prosecution of the petitioner shall be dropped, if the opposite party no.2 doesn't appear in the Court within the aforesaid 15 days till the prosecution shall be dropped, if the petition for withdrawing the prosecution is filed and pending.
