Petitioner is the husband who is apprehending arrest in connection with Complaint Case No. 1517 of 2018 corresponding to T.R. No. 3159 of 2019 for the offence under Sections 498(A) of the Indian Penal Code.

Learned counsel for the petitioner would submit that the petitioner has no criminal antecedent. He further submits that the complainant is wife and the petitioner is husband. It has been submitted in paragraph No. 19 of this petition that the petitioner is ready to keep his wife.

No. 25943 of 2020(2) dt.05-11-2020 2/2 Considering the aforesaid fact, the Court is inclined to grant bail to the petitioner in order to promote normal conjugal life between husband and wife, let the petitioner named above, be released on bail in the event of arrest or surrender before the court below within a period of one month from the date of communication of a copy of this order on furnishing bail bond of Rs.25,000/- (twenty-five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IX, Darbhanga, in connection with Complaint Case No. 1517 of 2018, subject to the condition as laid down under section 438(2) of the Cr.P.C. In the event, the petitioner (husband), neglects, misbehaves or tortures the complainant (his wife), the Court below shall be at liberty to cancel the bail bonds of the petitioner.
