JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-10-2016 The present application has been filed for cancellation of bail of O.P. No. 2 who was granted bail vide order dated 16.04.2012 passed in Cr. Misc. No. 12965 of 2012 in connection with Siwaipatti P.S. Case No. 104 of 2011 registered under Sections 307, 323, 324, 341, 379 of the Indian Penal Code.
The prosecution case is that the O.P. No. 2 caused dagger blow on the chest of the informant and taken away Rs. 5000/- of the informant.
On submission of the counsel for the O.P.
No. 2 that only one injury has been found, simple in nature and for the occurrence of 30.11.2011 the First Information Report was registered on 07.12.2011, the O.P. No. 2 was granted anticipatory bail.
In the present cancellation application, no
Patna High Court Cr.Misc. No.33713 of 2012 (2) dt.05-10-2016 2/2 specific ground has been taken for cancellation of bail of O.P. No. 2. The parameters for grant of bail and its cancellation are quite different. Moreover, no averment has been made in the petition that O.P. No. 2 has misused the privilege of bail. This Court finds no merit in the application. The application stands dismissed arising out of Siwaipatti P.S.
