JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 13-10-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Piri Bazar P. S. Case No. 31 of 2015 registered under Sections 341, 323, 324, 326, 504 and 307/34 of the Indian Penal Code. It is contended that there is a case and counter case and the injuries sustained by the grand-father of the informant are simple in nature.

Be that as it may, regard being had to the fact that the petitioner is alleged to have assaulted with khanti on the head of the grand-father of the informant which finds corroboration from the medical report of the doctor, who had examined the victim, I am not inclined to grant the privilege of anticipatory bail to the

Patna High Court Cr.Misc. No.42482 of 2015 (2) dt.13-10-2015 2/2 petitioner. Accordingly, the application is rejected. However, in case, the petitioner surrenders and seeks bail, the same shall be considered on its own merit without being prejudiced in any manner by this order.
