The petitioner apprehends his arrest in a case registered for the offence under Section 414 of the Indian Penal Code and Section 7 of the E.C.Act.

As per the prosecution case, 12 bags of fertilizers have been recovered from a truck and 30 bags of fertilizers were recovered from the house of co-accused Md.Taufiq. Petitioner is not named in the F.I.R. Name of the petitioner transpired during course of investigation. Petitioner is alleged to be driver of the truck in question. It is submitted on behalf of petitioner that petitioner is not driver of the truck in question and has got no concern with the alleged recovery. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.22889 of 2022(2) dt.06-09-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances as well as clean antecedent , let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Birpur, Supaul in connection with Birpur P.S. Case No. 7 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
