JUSTICE SHAILENDRA SINGH ORAL ORDER 21-01-2025 Heard Mr. Pravin Kumar, learned counsel for the petitioner, Mr. Rajendra Singh Shastri, learned APP for the State and Mr. Utkarsh Utpal, learned counsel for the BSFC.

2. The instant petition has been filed for modification in the order dated 06.08.2015 passed in Cr. Misc. No. 39 of 2015 with regard to the period for the depositing the amount to the tune of Rs. 10,32,448/-.

3. Learned counsel for the petitioner submits that petitioner had filed Cr. Misc. No. 26516 of 2015 for the relief of anticipatory bail which was disposed of vide order dated 02.07.2015 with a liberty to the petitioner to approach before the learned Sessions Judge, Aurangabad for extension of the period of depositing the alleged amount and thereafter the petitioner

Patna High Court CR. MISC. No.43527 of 2015(5) dt.21-01-2025 2/2 filed a petition before the learned Sessions Judge, Aurangabad by way of Cr. Misc. No. 34 of 2015 and in that petition the period of depositing the alleged amount was extended and the petitioner was directed to surrender before the court concerned. It is further submitted that petitioner fell ill and he could not deposit the alleged amount within the time frame prescribed by the learned Sessions Judge, Aurangabad and again prayed for extension of period of one year for depositing the alleged amount by filing Cr. Misc. No. 39 of 2015 and the time for depositing the alleged amount was extended by 15 days.

4. Learned counsel for the BSFC and learned APP for the State are present.

5. After having gone through the contents of the petition, this court finds no merit in the petition and the same stands dismissed.
