====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER --------------- 03-08-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State as also the learned counsel for the opposite party no.2.

The petitioner apprehends his arrest in connection with Khaira (Nagra) P.S. Case No.98 of 2015, arising out of Complaint Case No.1619 of 2015, registered under Sections 379, 498(A) and 365 of the Indian Penal Code besides Sections 3/4 of the Dowry Prohibition Act. Learned counsel for the petitioner and the learned counsel for the opposite party no.2 submit that the dispute in between the petitioner and the opposite party no.2 has been settled by the Mediator of the Patna High Court Mediation Centre, Patna, in terms of the agreement entered into between them, which is the part of the report of the

Patna High Court Cr.Misc. No.10263 of 2017 (4) dt.03-08-2017 2/2 Mediator of the Patna High Court Mediation Centre, Patna. Accordingly, the petitioner will pay Rs.90,000/- to the opposite party no.2, out of which Rs.20,000/- has already been paid by the petitioner to the opposite party no.2 and the rest amount would be paid by the petitioner to the opposite party no.2 within four months and, thereafter, the petitioner and the opposite party no.2 will withdraw the cases pending against each other.

Since the petitioner and the opposite party no.2 have settled their dispute before the Mediator, Patna High Court Mediation Centre, Patna, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Saran at Chapra, in connection with Khaira (Nagra) P.S. Case No.98 of 2015, arising out of Complaint Case No.1619 of 2015, subject to the conditions laid down under Section 438(2) Cr.P.C.
