This is a petition for grant of anticipatory bail for offence under Sections 304B and 201/34 of the Penal Code. The petitioners are the sister-in-law and mother-inlaw and there is allegation that the victim-deceased has been done to death for non-fulfillment of demand. The learned counsel for the petitioners submits that petitioner no. 1 is the married sister-inlaw and petitioner no. 2 is mother-in-law and the married nanad (sister-in-law) lives at quite a distance. The learned counsel for the State is unable to disclose the cause of death from the case diary. The dead body was received from a pond in the village found floating.
Hence, having regard to the facts and circumstances of the case, the petitioners, above named, in the event of their arrest or surrender, within four weeks from the date of receipt of this order, are directed to be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each
Patna High Court Cr.Misc. No.15047 of 2015 (3) dt.02-09-2015 with two sureties of the like amount each in connection with the Palanwa P.S. Case No. 22 of 2013 to the satisfaction of Sri K. Prasad, Judicial Magistrate, 1st Class, Raxaul at Motihari, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
