JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-04-2019 Earlier the prayer for bail of the petitioner was dismissed vide order dated 24.07.2018 passed in Cr. Misc. No. 40727 of 2018 and allegation against the petitioner is collecting money from different persons for providing the job in the Government/non Government organization.

Submission of learned counsel for the petitioner petitioner has been languishing in judicial custody since 04.01.2018 and other co-accused persons have already been granted the privilege of bail and there is no likelihood of conclusion of trial in near future.

Heard learned A.P.P. as well as learned counsel for the informant. They have opposed the prayer for bail. Learned counsel for the informant has submitted that the delay in

Patna High Court CR. MISC. No.19676 of 2019(2) dt.04-04-2019 2/2 disposal of trial is on the part of the petitioner side as a discharge petition has been filed on behalf of defence and not appearing in the said discharge petition.

Having heard both sides, considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail.

Learned trial court is directed to dispose of the discharge petition and proceed further in trial and dispose of the same as expeditiously as possible.

This application is accordingly dismissed.
