01-08-2016 Heard Sri Ansul, learned counsel for the petitioner and Sri Rana Randhir Singh, learned Addl. Public Prosecutor. In this case, earlier a report was called for from the court below regarding stage of the case, which has been received and kept on record. The report dated 23rd July, 2016 of learned I/c Judicial Magistrate, Vaishali at Hajipur indicates that after conclusion of the prosecution evidence, the statement of accused under Section 313 of the Cr.P.C. has already been recorded. After noticing the report of the court below, learned counsel for the petitioner makes a prayer for withdrawal of the petition. The prayer is allowed.

The petition stands dismissed as withdrawn.
