JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 13-10-2015 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner seeks pre-arrest bail in connection with Amarpur P. S. Case No. 194 of 2015 registered under Sections 341, 323, 307, 325, 379, 354 B, 385, 504 and 506/34 of the Indian Penal Code.
It is contended that there is a case and counter case. The counter case has been instituted on the basis of fardbeyan of uncle of the petitioner. It is further contended that the petitioner and his uncle had sustained injuries in the alleged incident. As a matter of fact, the members of the prosecution party were aggressors and when they started assaulting the petitioner and his uncle, in
Patna High Court Cr.Misc. No.42500 of 2015 (2) dt.13-10-2015 2/2 defence, the petitioner is alleged to have given one blow with iron rod on the leg of the informant, which is not a vital part of the body.
Learned counsel for the State has opposed the prayer for grant of anticipatory bail to the petitioner. Regard being had to the facts and circumstances of the case, in the event of arrest or surrender before the court below within six weeks from today, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in Amarpur P. S. Case No. 194 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
