Petitioners seek bail in a case registered under sections 366A and 120B of the Indian Penal Code.
The statement of victim recorded under section 164 Cr.P.C goes to show that victim was taken away near from her house by one Munni Kumari who happens to be daughter of petitioner no.1 and subsequently, she was taken to a field where petitioners and some other accused were present. However, victim claims that she was taken away from there by co- accused Ram Kripal Mandal who happens to be son of petitioner no.1 and after that victim was taken to different places by different persons.
Submission on behalf of the petitioners is that no specific overt-act has been attributed against these petitioners and except the presence of the petitioners at one place, there is nothing against them. Petitioners are in jail custody since 14.11.2016 and investigation
Patna High Court Cr.Misc. No.978 of 2017 (2) dt.13-01-2017 against them has already been completed Accordingly, petitioners are directed to be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Katihar/ concerned court in Azam Nagar P.S. Case no. 123/2015.
