The petitioner apprehends his arrest in a case under Sections 467, 420, 406, 468 of the Indian Penal Code and Section 138 of the N.I. Act.

The informant alleged that the petitioner took Rs. 3,55,000/- for providing the informant a job but no job was provided to him. The petitioner returned the money through a cheque but the cheque was dishonoured. It is submitted that during the course of investigation all the witnesses including the brother of the informant stated that the petitioner had borrowed money from the informant and, at best, an offence under Section 138 N.I. Act is made out which is bailable.

On the other hand, learned counsel for the informant and learned A.P.P. vehemently opposed the prayer for bail.

No.42597 of 2015 (3) dt.03-12-2015 2/2 Considering the the nature of allegation made against the petitioner and the fact that the case appears to be a case of bouncing of the cheque, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad in Makhdumpur P.S.
