Heard learned counsel for the petitioner and learned counsel for the State.
Petitioner apprehends his arrest in a case registered under Sections 399, 414, 402 of the Indian Penal Code and Sections 25(1-b)a, 26, 35 of the Arms Act.
Allegation is recovery of Apache motorcycle, dagger, loaded pistol with cartridges and mobile from the possession of petitioner and other co-accused. It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case only
Patna High Court CR. MISC. No.26024 of 2020(2) dt.20-10-2020 2/2 on the basis of confessional statement of apprehended person Dipak Kumar. Nothing was recovered from his possession nor he was apprehended on the spot.
Petitioner has several criminal antecedents, as such I am not inclined to grant bail to the petitioner, hence, the prayer for bail of the petitioner is hereby rejected. However, if petitioner surrenders and seeks regular bail then his prayer for regular bail shall be considered preferably on the same day on its own merits without being prejudiced by this order.
