JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-05-2019 This is an application for grant of anticipatory bail in connection with Barun P.S. Case No. 208 of 2018, disclosing offences under Sections 379, 411, 420 of the Indian Penal Code and Section 4, 40 of the Bihar Mineral Rules and also under Section 15 of the Environment Act.
Allegation as per F.I.R. is that police has seized two trucks loaded with sand and petitioner happens to be the driver. Submission of learned counsel for the petitioner is that he is only a driver and owner of the truck has already been granted privilege of anticipatory bail by a Coordinate Bench of this Court vide order dated 14.03.2019 passed in Cr. Misc. No. 15916 of 2019.

Having heard both sides, considering the above
Patna High Court CR. MISC. No.20648 of 2019(2) dt.08-05-2019 2/2 submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Barun P.S.
