2. The petitioner apprehends his arrest in connection with Muzaffarpur Sadar P.S. Case No. 669 of 2024, registered under Sections 115(2), 126(2), 303(2), 352, 351(2), 109 & 3(5) of the Bhartiya Nyaya Sanhita.

3. The case of the prosecution is that on 10th October, 2024, around midnight, the informant, Md. Khursid, was eating food at a hotel when the petitioners entered the hotel. They approached the informant and demanded the key of his

Patna High Court CR. MISC. No.24512 of 2025(2) dt.06-05-2025 2/3 motorcycle. Upon refusal, the accused abused and physically assaulted the informant. Another accused, Pramod Rai, hit the informant with a pistol while others used belt and knife causing injuries. It is also alleged that the petitioners stole Rs. 5000/- from the informant's pocket and Pramod Rai snatched a gold chain worth Rs.65,000/- from his neck. It is also alleged that the accused also threatened the informant with dire consequences of murder and gunfire.

4. Learned Counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. The petitioners further submits that they have clean antecedent. The petitioners also submits that there is no specific allegation against the petitioners of having used of pistol or knife causing injuries and that there is general and omnibus allegation against the petitioners. The petitioners also asserts that the injuries demonstrate that the injuries sustained by the informant is simple in nature.

5. Learned Additional Public Prosecutor has vehemently opposed the prayer for anticipatory bail.

6. Taking into account the fact that the injury found to be simple in nature, the petitioners have clean antecedent, there is no specific allegation against the petitioners having

No.24512 of 2025(2) dt.06-05-2025 3/3 assaulted the informant with pistol or knife and also the fact that co-accused, Pramod Rai has already been granted privilege of anticipatory bail vide order dated 24.04.2025 in Cr. Misc. No.20952 of 2025, this Court is inclined to grant the petitioners privilege of anticipatory bail.

7. Let all the petitioners, named above, in the event of their arrest or surrender before the Court below within four weeks from today, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, in connection with Muzaffarpur Sadar P.S. Case No. 669 of 2024, subject to the condition laid down under Section 482 of the Bhartiya Nyaya Sanhita. (Alok Kumar Sinha, J) sanjeev/- U T
