JUSTICE MOHIT KUMAR SHAH ORAL ORDER 12-12-2022 Though the present writ petition has been filed for directing the Respondent authorities to make payment of the family pension and other benefits to the mother of the petitioner by granting benefits of 2nd ACP, in lieu of the death of the father of the petitioner on 27.6.2014, while working as Fodder Overseer, District Animal Husbandry Office, District-Saran at Chapra, however, the learned counsel for the RespondentState has referred to paragraphs no. 7to 9 of the counter affidavit, filed in the present case, wherein it has been stated that the deceased father of the
Patna High Court CWJC No.22197 of 2014(2) dt.12-12-2022 2/2 petitioner has already been granted revised ACP with effect from 9.8.1999 in the scale of Rs. 45007000/- and 2nd ACP in the grade pay of 4200/- with effect from 1.1.2009.
In view of the aforesaid, I deem it fit and proper to dispose of the present writ petition, however, with a direction to the Respondent authorities to revise the family pension, being paid to the mother of the petitioner, in case the same has not been revised, upon grant of 1st and 2nd ACP, as aforesaid and pay the arrears thereof forthwith.
The writ petition stands disposed of on the aforesaid terms.
