The petitioner is apprehending her arrest in connection with Thakurganj P.S. Case No. 82 of 2016 registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.

Petitioner is named in the FIR and there is allegation that she along with co-accused persons has killed the deceased. It has been submitted on behalf of the petitioner that except suspicion there is nothing against the petitioner and there is no evidence of any last seen or anything against her and petitioner is mother-in-law of the deceased.

Heard learned APP also.

Having heard both sides and considering the facts and circumstances of the case and also considering the fact that

No.19519 of 2017 (2) dt.11-05-2017 2/2 petitioner is a lady, let the petitioner, named above, surrender in the court within a period of two weeks from the date of receipt/production of a copy of this order and the court below will release the petitioner on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kishanganj, in connection with Thakurganj P.S. Case No.

82 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that petitioner shall co-operate in the investigation and make himself available before the police as and when required and in the event of failure on her part to appear before the police on two consecutive dates, the prosecution shall be free to move for cancellation of her bail bonds and further petitioner will not induce any witness or tamper with the evidence and further if any incriminating material has come against the petitioner, the prosecution will be free to move cancellation of her bail.
