The present petition was filed under Section 24 of the Code of Civil Procedure with a prayer to transfer the record of Divorce Case no.86 of 2012 from the Family Court, Bhojpur(Arrah) to the Family Court, Patna.
Learned counsel for the petitioner submits that on 23.02.2016, the husband, who was petitioner in Divorce Case No.86 of 2012, had filed an application for withdrawal of Divorce Case.
On instruction, Sri Uday Kumar, learned counsel
Patna High Court MJC No.791 of 2013 (4) dt.19-01-2017 2/2 for Opp.Party, informs the Court that now Divorce Case no.86 of 2012 has already been dismissed due to non-prosecution. Meaning thereby that the husband was not interested to pursue the divorce case.
Accordingly, since presently no case is pending before the Family Court, Bhojpur i.e. Divorce Case no.86 of 2012, no purpose would be served to further keep the matter pending. It goes without saying that if subsequently any cause of action arises, the petitioner would be at liberty to approach this Court.
The petition stands disposed of.
