JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 216A of the Indian Penal Code and Sections 25(1-B)a, 26 and 35 of the Arms Act. It is alleged that the police received information that Niraj Kumar and Santosh Kumar are tenants in the house of this petitioner when raid was led and three country made staingun, three country made pistol and two live cartridges were recovered. The petitioner was also named in the FIR as he allowed two criminals to reside in his house.
It is submitted by learned counsel for the petitioner that the petitioner is an employee of Bharat Coking Coal Limited and on the date of seizure, the petitioner was present at his place of employment and the house in question was given on rent to Niraj
Patna High Court Cr.Misc. No.1902 of 2015 (2) dt.16-01-2015 2/2 Kumar and Santosh Kumar. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Aurangabad in connection with Madanpur P.S. Case No. 157 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
Learned court below will cancel bail bonds of the petitioner if the fails to co-operate during trial if the trial has not concluded.
