The petitioner seeks bail in anticipation of his arrest in connection with G.O. Case No. 146 of 2020 arising out of Jale P.S. Case No. 19 of 2020 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It appears from the F.I.R. that 59.7 litres of liquor was recovered from near a tree behind the house of the petitioner.

It has been submitted on behalf of the petitioner

Patna High Court CR. MISC. No.26422 of 2020(2) dt.21-10-2020 2/2 that the recovery is from an open place and the petitioner has unnecessarily been saddled with the aforesaid accusation.

The petitioner claims to be a person of clean antecedents.

Considering the facts afore-stated, the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Addl. Sessions Judge-Cum-Special Judge, Excise Act, Darbhanga in connection with G.O. Case No. 146 of 2020 arising out of Jale P.S. Case No. 19 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
