The petitioner seeks bail in connection with Parihar P. S. Case No. 221 of 2019 dated 01.11.2019 instituted for the offences under Sections 457 and 380 of the Indian Penal Code.

The petitioner is not named in the F.I.R. However, on suspicion, the petitioner was arrested and from his possession a looted mobile phone is said to have been recovered.

The petitioner contends that the mobile phone

Patna High Court CR. MISC. No.20627 of 2020(2) dt.23-06-2020 2/2 which was recovered is not the looted property. The learned counsel for the State has drawn the attention of this Court to the criminal antecedents of the petitioner.

The petitioner appears to have been made accused in cases of similar nature in the past.

However, taking into account the fact that the petitioner is in custody since 02.01.2020 in this case and the nature of accusation against him, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate I/C, Sitamarhi in connection with Parihar P. S. Case No. 221 of 2019.

The petition stands allowed.
