Earlier the prayer for bail of the petitioner was rejected by this Court taking note of allegation against the petitioner but the trial court has reported that the charge against the petitioner was framed on 23.08.2016 but up till now, not a single prosecution witness was examined. Petitioner is in jail custody since 9.11.2015 and he has sufficiently been punished by remaining in jail custody for such a long period.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Judicial Magistrate,1st class, Araria in connection with Fulkaha P.S.Case
