====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 03-12-2021 Heard the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Kuchaikote P. S. Case No.68 of 2021, instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

The learned counsel for the petitioner submits that the petitioner is in custody since 20.02.2021 and charge-sheet has been submitted in this case.

Allegation is of recovery of 891.720 litres of liquor was recovered. The apprehended accused persons disclosed the name of this petitioner.

The learned counsel for the petitioner submits that

No.35454 of 2021(2) dt.03-12-2021 2/2 petitioner has been falsely implicated in this case based on confessional statement of co-accused and there is an error in the record of the learned Court below where it has been recorded that the petitioner was arrested at the spot as pleaded in Para-6 of the bail petition.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody since 20.02.2021 and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Gopalganj in connection with Kuchaikote P. S. Case No.68 of 2021.

The application stands allowed.
