JUSTICE MIHIR KUMAR JHA ORAL ORDER 06-02-2015 Having regard to the fact that the petitioner is an employee of Bihar State Road Transport Corporation (hereinafter referred to as the Corporation) and having superannuated w.e.f from 30.11.2011, he is said to have not been paid his retrial dues, this Court would direct the competent authority of the Corporation to take a decision for payment of its retirement benefit, if any, within a period of three months from the date of filing of such representation by the petitioner along with a copy of this order. It is also made clear that while complying the order of this Court the respondent-Corporation will

Patna High Court CWJC No.237 of 2015 (2) dt.06-02-2015 be only required to consider and make payment of retirement benefit as admissible to the employees of the Corporation.

In the event, the petitioner is not found entitled, for payment of such retirement benefit claimed by him, the reasons thereof must be communicated to him. With the aforementioned observation and direction, this application is disposed of.
