JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-04-2017 The petitioners are apprehending their arrest in connection with Khushrupur P.S. Case No. 174 of 2016 registered for offences punishable under Sections 302 and 201/34 of the Indian Penal Code.
It has been submitted on behalf of the petitioners that there is nothing on record against them. The daughter of the petitioner no.3 had an affair with the deceased and as such it has been suspected that they in collusion with one Akhilesh Kumar co-accused has got him killed and it has further been submitted that as Akhilesh Kumar whose name has been transpired in the case during the investigation that he on the instruction of petitioners, got killed the deceased. It has also been submitted that
Patna High Court Cr.Misc. No.17725 of 2017 (2) dt.25-04-2017 2/2 an application has been filed by Surat Singh, grandfather of the deceased against Akhish Kumar and Akhilesh Kumar was made accused in the case and he has been released on bail by Hon'ble Court as appears from Annexure-2 and the case of the petitioner is better footing than of Akhilesh Kumar.

Learned counsel for the informant raised strong suspicion against the petitioners that daughter of petitioner no.3 had love affairs with the deceased and they got the deceased killed.
Having heard both sides and in view of the facts as stated above, let the petitioners surrender before the court below and maker prayer for regular bail which will be considered on the basis of material available on record and also considering the facts that other co-accused Akhilesh Kumar has already been granted by this Hon'ble Court and considering this aspect of the matter the court below will pass appropriate order without being prejudiced by the order of this court.
Accordingly, the petition is disposed off.
