====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 10-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Special Case No. 51 of 2018 arising out of Daniyawan P.S. Case No. 68 of 2018 instituted for the offence under Sections 20 and 22 of NDPS Act.

Counsel for the petitioner submits that petitioner is lady. She is in custody since 25.5.2018. In the seizure list it is mentioned that recovery of Ganja has been made from the room taken on rent by Rajanti Devi in the house of one Satyendra Gope. The petitioner was found sitting in the aforesaid house.

From the seizure list as well as written report it appears that there is no recovery of Ganja from conscious possession of this petitioner. She is in custody since 25.5.2018

Patna High Court Cr.Misc. No.70957 of 2018(2) dt.10-12-2018 2/2 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-Xth/Special Judge, Patna, in connection with Special Case No. 51 of 2018 arising out of Daniyawan P.S. Case No. 68 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
